Terms of Service

This is a convenience translation. The French version is the legally binding text.

Welcome to Odyssey. These Terms of Service (hereinafter "ToS") govern access to and use of the Odyssey mobile application and its associated services.

Using Odyssey implies full and unreserved acceptance of these ToS. If you do not agree with any of their provisions, you must immediately stop using the service.

Use of Odyssey is strictly reserved for natural persons at least 16 years old, with the legal capacity necessary to enter into these ToS.

For users under 18, use of the Service is subject to prior authorization from the holders of parental authority.

When registering, the User undertakes to provide accurate, complete and up-to-date information. Identity theft is prohibited and exposes its author to criminal prosecution (Article 226-4-1 of the French Criminal Code).

The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their account.

The User acknowledges that Odyssey is a recreational sports tool and not a medical device.

The User undertakes to:

Odyssey cannot be held liable for the direct or indirect consequences (injuries, accidents, medical complications) resulting from the User's use of the Service.

The displayed health indicators (max HR, heart rate zones, calories, etc.) are indicative estimates based on statistical models and cannot replace a professional medical assessment.

5. Use of the service

The User undertakes to use the Service fairly and in accordance with these ToS. In particular, they shall refrain from:

We reserve the right to moderate content published on the Service and to remove, without notice, any content deemed contrary to these ToS, to public order or to public decency.

In the event of a serious or repeated breach, the User's account may be suspended temporarily or permanently without compensation and without notice.

6. User content

6.1. Ownership

The User remains the sole owner of the Content they publish on the Service.

6.2. License granted to Odyssey

By publishing Content on the Service (GPS routes, photos, crew/club posts, bio, etc.), the User grants Odyssey a non-exclusive, worldwide, free license limited to the duration of use of the Service, to reproduce, display and distribute this Content strictly within the operation of the Service (public display on their profile, sharing with the members of their crews/clubs, etc.).

This license terminates automatically when the Content is deleted by the User or when their account is terminated.

6.3. Responsibility

The User is solely responsible for the Content they publish. They indemnify Odyssey against any third-party claim based on the infringement of their rights by said Content (infringement of image rights, copyright, privacy, etc.).

7. Paid features (Premium)

7.1. Offer

Certain advanced features of the Service are accessible via the auto-renewable paid subscription "Odyssey Premium", offered at €4.99 per month or €22.99 per year. The prices displayed in the app depend on the country of the User's account with the store the app came from (App Store on iPhone, Google Play on Android). The rest of the app remains free.

7.2. What the offer includes

The Premium subscription gives access to:

New subscribers benefit from a 14-day free trial. Unless the subscription is cancelled at least 24 hours before the end of the trial, the paid subscription starts automatically.

7.4. Billing, renewal and cancellation

The purchase, billing, renewal and cancellation of the subscription are handled by the store the app came from: Apple (App Store) on iPhone, Google (Google Play) on Android. Payment is charged to the User's account with that store. The subscription renews automatically at each expiry, unless cancelled at least 24 hours before the end of the current period. The User can manage and cancel their subscription at any time:

The right of withdrawal provided for by European Union law is also exercised through the relevant store, Apple or Google.

7.6. Gift codes

Odyssey may issue gift codes granting access to Premium for a fixed period or for life. These codes are free, personal at the time of use (one use per account), cannot be exchanged for money, are non-refundable and have no monetary value. Odyssey may limit or revoke their use in the event of abuse or resale.

7.7. Price changes

Any price change will be notified to the User in accordance with the rules of the store the app came from (App Store or Google Play) and will only apply from the next renewal.

7.8. Effect of cancellation

Cancelling the subscription does not entail the deletion of the account. Upon expiry of the current period, the account reverts to the free tier: the User's data is not deleted and the free-tier limits apply again.

We make every effort to ensure the availability of the Service 24/7. However, this availability cannot be guaranteed in the event of:

We reserve the right to evolve the Service at any time, by adding, modifying or removing features. Substantial changes will be notified to the User via the app or by email.

10. Limitation of liability

To the extent permitted by law, Odyssey cannot be held liable for:

Odyssey's liability, should it be engaged, shall be limited to the amount paid by the User over the last 12 months for the Premium subscription, where applicable. For free users, Odyssey's liability may not exceed a symbolic amount of €100.

11. Amendment of the ToS

We reserve the right to modify these ToS at any time. Substantial changes will be notified to the User via the app at least 30 days before they take effect, unless they result from a legal or regulatory obligation.

Continued use of the Service after the new ToS take effect constitutes acceptance. Otherwise, the User may terminate their account in accordance with Article 8.1.

12. Personal data

The processing of personal data is governed by our Privacy Policy, compliant with the GDPR and the French Data Protection Act.

13. Governing law and dispute resolution

In the event of a dispute, the User is invited to first contact our support team at support@runodyssey.com to seek an amicable solution.

13.3. Consumer mediation

In accordance with Article L. 612-1 of the French Consumer Code, the consumer User may resort free of charge to the following consumer mediator:

13.4. Competent courts

Failing an amicable agreement, any dispute relating to the interpretation or performance of these ToS falls under the exclusive jurisdiction of the Paris Court, unless a mandatory legal provision of public order provides otherwise.
